1. Acceptance of Terms

By accessing or using curavidas, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. These terms apply to all users of the service, including therapists and their clients.

2. Description of Service

curavidas is an online appointment scheduling platform that connects therapists with their clients. The platform allows therapists to manage their availability, accept bookings, and communicate appointment details to clients through automated notifications. Therapists may also embed a booking widget on their own websites to allow clients to schedule appointments directly.

3. User Accounts

Therapists access the platform by signing in through Google OAuth. By creating an account, you agree to the following:

• You are responsible for maintaining the security of your account and any activity that occurs under it.
• You must have the authority to connect your calendar (Google Calendar) to the platform.
• You must provide accurate and up-to-date information in your profile.
• You agree not to share your account credentials or allow others to access your account.

Clients do not create accounts. Client identity is verified through email confirmation links sent to the email address provided at the time of booking.

4. Booking Terms

Clients who book appointments through curavidas agree to the following:

• You must provide accurate contact information when making a booking.
• Cancellation policies are set by the individual therapist. Please review the therapist's cancellation policy before booking.
• By booking an appointment, you consent to receiving transactional emails, including booking confirmations and appointment reminders. You may unsubscribe from reminder emails at any time using the unsubscribe link included in each email.

5. HIPAA Compliance and Protected Health Information

curavidas recognizes that appointment scheduling data associated with therapy services may constitute Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). curavidas operates as a Business Associate under HIPAA when handling data on behalf of therapists who are Covered Entities.

To protect this information, curavidas maintains the following safeguards:

• Sensitive credentials and authentication tokens are encrypted at rest using AES-256-GCM encryption.
• All data is transmitted over TLS-encrypted connections.
• Transactional emails are sent through Paubox, a HIPAA-compliant, HITRUST-certified email service with an executed Business Associate Agreement (BAA).
• Infrastructure and hosting services are provided by HIPAA-eligible vendors with executed BAAs.
• Access to PHI is limited to the therapist who owns the data and authorized platform administrators for support purposes only.

Therapists who are Covered Entities under HIPAA may request a Business Associate Agreement by contacting us at gregory@curavidas.com.

6. Prohibited Uses

You agree not to use curavidas for any of the following purposes:

• Submitting spam or fraudulent bookings, including making appointments you do not intend to keep.
• Abusing, disrupting, or interfering with the operation of the platform.
• Scraping, crawling, or using automated tools to extract data from the platform.
• Attempting to access another user's account, data, or personal information without authorization.

7. Third-Party Services

curavidas integrates with the following third-party services to provide its functionality:

• Google Workspace (Google Calendar, Google Meet) for listing your calendars, creating and managing appointment events, querying free/busy availability, receiving real-time calendar change notifications, and video meetings.
• Zoom for video meeting links.
• Paubox for HIPAA-compliant transactional email delivery.

Your use of these services is subject to their respective terms of service and privacy policies. curavidas is not responsible for the availability, accuracy, or content of these third-party services. Appointment details, including appointment type names and scheduling information, may be shared with these services as necessary to provide the platform's functionality.

8. Data Collection and Privacy

curavidas collects and processes the following categories of data:

• Therapist data: name, email address, profile image, timezone, calendar selection (which calendars to sync and which is the primary), and encrypted OAuth credentials.
• Client data: name, email address, phone number, and appointment details provided at the time of booking.
• Technical data: IP addresses are collected for rate limiting and anti-spam protection on public-facing endpoints.
• Usage data: basic, privacy-friendly analytics are collected through Vercel Analytics and Vercel Speed Insights to monitor platform performance. No third-party advertising trackers are used.

9. Email Communications

curavidas sends transactional emails related to appointment scheduling, including booking confirmations, reminders, reschedule notices, and cancellation notices. These emails are delivered through Paubox, a HIPAA-compliant email service. Email delivery status (such as whether an email was delivered or bounced) is tracked to ensure reliable communication. You may unsubscribe from non-essential email communications at any time using the unsubscribe link provided in each email.

10. Embeddable Booking Widget

Therapists may embed a curavidas booking widget on their own websites. By using the embeddable widget, therapists acknowledge and agree to the following:

• The therapist is responsible for ensuring their own website complies with applicable privacy laws and that their visitors are informed about the data collected through the widget.
• Client data submitted through the widget is transmitted directly to curavidas and is subject to these Terms and our Privacy Policy.
• curavidas is not responsible for the content, privacy practices, or security of the therapist's website.

11. Intellectual Property

The curavidas platform, including its design, code, features, and branding, is the property of curavidas and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the platform without our prior written consent.

Therapists retain ownership of the content they create on the platform, including profile information, appointment type descriptions, and widget customizations. By using the platform, you grant curavidas a limited, non-exclusive license to display and transmit this content as necessary to provide the service.

12. Data Retention and Deletion

Appointment records and associated client data are retained for as long as the therapist's account is active, consistent with professional record-keeping requirements for healthcare providers. Audit logs and notification records are retained for operational and compliance purposes.

Clients may request deletion of their personal data at any time by contacting us at gregory@curavidas.com. We will respond to deletion requests within 30 days, subject to any legal obligations that require us to retain certain records.

Therapists may request account deletion by contacting us. Upon account deletion, we will remove the therapist's profile and authentication credentials. Appointment records may be retained as required by applicable healthcare record-keeping laws.

13. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service or engage in conduct that we reasonably believe is harmful to the platform, other users, or third parties. You may terminate your account at any time by contacting us at gregory@curavidas.com. Upon termination, your right to access the platform will cease immediately. Data retention following termination is governed by Section 12 of these terms.

14. Indemnification

You agree to indemnify, defend, and hold harmless curavidas and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the platform, your violation of these Terms of Service, or your violation of any rights of another person or entity.

15. Disclaimer

curavidas is a scheduling tool, not a healthcare provider. We do not provide medical advice, diagnosis, or treatment. The platform facilitates appointment scheduling between therapists and their clients but does not participate in, endorse, or take responsibility for the therapeutic services provided.

16. Limitation of Liability

To the maximum extent permitted by applicable law, curavidas and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the platform. In no event shall our total liability exceed the amount you paid to us, if any, during the twelve months preceding the claim. The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

17. Modifications

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of curavidas after any modifications constitutes acceptance of the revised terms. We encourage you to review this page periodically.

18. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in San Diego County, California.
